ל"ו:א׳ וַֽיִּקְרְב֞וּ רָאשֵׁ֣י הָֽאָב֗וֹת לְמִשְׁפַּ֤חַת בְּנֵֽי־גִלְעָד֙ בֶּן־מָכִ֣יר בֶּן־מְנַשֶּׁ֔ה מִֽמִּשְׁפְּחֹ֖ת בְּנֵ֣י יוֹסֵ֑ף וַֽיְדַבְּר֞וּ לִפְנֵ֤י מֹשֶׁה֙ וְלִפְנֵ֣י הַנְּשִׂאִ֔ים רָאשֵׁ֥י אָב֖וֹת לִבְנֵ֥י יִשְׂרָאֵֽל׃
36:1 The family heads in the clan of the descendants of Gilead son of Machir son of Manasseh, one of the Josephite clans, came forward and appealed to Moses and the chieftains, family headsaI.e., tribal heads. of the Israelites.
36:1 And the heads of the fathers’houses of the family of the children of Gilead, the son of Machir, the son of Manasseh, of the families of the sons of Joseph, came near, and spoke before Moses, and before the princes, the heads of the fathers’houses of the children of Israel;
ל"ו:א׳ וְקָרִיבוּ רֵישֵׁי אֲבָהָתָא לְזַרְעִית בְּנֵי גִּלְעָד בַּר מָכִיר בַּר מְנַשֶּׁה מִזַּרְעֲיַת בְּנֵי יוֹסֵף וּמַלִּילוּ קֳדָם משֶׁה וְקֳדָם רַבְרְבַיָּא רֵישֵׁי אֲבָהָתָא לִבְנֵי יִשְׂרָאֵל:
ל"ו:ב׳ וַיֹּאמְר֗וּ אֶת־אֲדֹנִי֙ צִוָּ֣ה יְהוָ֔ה לָתֵ֨ת אֶת־הָאָ֧רֶץ בְּנַחֲלָ֛ה בְּגוֹרָ֖ל לִבְנֵ֣י יִשְׂרָאֵ֑ל וַֽאדֹנִי֙ צֻוָּ֣ה בַֽיהוָ֔ה לָתֵ֗ת אֶֽת־נַחֲלַ֛ת צְלָפְחָ֥ד אָחִ֖ינוּ לִבְנֹתָֽיו׃
36:2 They said, “The LORD commanded my lord to assign the land to the Israelites as shares by lot, and my lord was further commanded by the LORD to assign the share of our kinsman Zelophehad to his daughters.
36:2 and they said: ‘The LORD commanded my lord to give the land for inheritance by lot to the children of Israel; and my lord was commanded by the LORD to give the inheritance of Zelophehad our brother unto his daughters.
ל"ו:ב׳ וַאֲמָרוּ יָת רִבּוֹנִי פַּקִּיד יְיָ לְמִתַּן יָת אַרְעָא בְּאַחֲסָנָא בְּעַדְבָא לִבְנֵי יִשְׂרָאֵל וְרִבּוֹנִי אִתְפַּקַּד בְּמֵמְרָא דַיְיָ לְמִתַּן יָת אַחֲסָנַת צְלָפְחָד אָחוּנָא לִבְנָתֵיהּ:
ל"ו:ג׳ וְ֠הָיוּ לְאֶחָ֞ד מִבְּנֵ֨י שִׁבְטֵ֥י בְנֵֽי־יִשְׂרָאֵל֮ לְנָשִׁים֒ וְנִגְרְעָ֤ה נַחֲלָתָן֙ מִנַּחֲלַ֣ת אֲבֹתֵ֔ינוּ וְנוֹסַ֕ף עַ֚ל נַחֲלַ֣ת הַמַּטֶּ֔ה אֲשֶׁ֥ר תִּהְיֶ֖ינָה לָהֶ֑ם וּמִגֹּרַ֥ל נַחֲלָתֵ֖נוּ יִגָּרֵֽעַ׃
36:3 Now, if they marry persons from another Israelite tribe, their share will be cut off from our ancestral portion and be added to the portion of the tribe into which they marry; thus our allotted portion will be diminished.
36:3 And if they be married to any of the sons of the other tribes of the children of Israel, then will their inheritance be taken away from the inheritance of our fathers, and will be added to the inheritance of the tribe whereunto they shall belong; so will it be taken away from the lot of our inheritance.
ל"ו:ג׳ וִיהֶוְיַן לְחַד מִבְּנֵי שִׁבְטַיָּא דִבְנֵי יִשְׂרָאֵל לִנְשִׁין וְתִתְמְנַע אַחֲסַנְתְּהוֹן מֵאַחֲסָנַת אֲבְהָתָנָא וְתִתּוֹסַף עַל אַחֲסָנַת שִׁבְטַיָּא דִּי יֶהֶוְיָן לְהוֹן וּמֵעֲדַב אַחֲסַנְתָּא יִתִּמְנָע:
ל"ו:ד׳ וְאִם־יִהְיֶ֣ה הַיֹּבֵל֮ לִבְנֵ֣י יִשְׂרָאֵל֒ וְנֽוֹסְפָה֙ נַחֲלָתָ֔ן עַ֚ל נַחֲלַ֣ת הַמַּטֶּ֔ה אֲשֶׁ֥ר תִּהְיֶ֖ינָה לָהֶ֑ם וּמִֽנַּחֲלַת֙ מַטֵּ֣ה אֲבֹתֵ֔ינוּ יִגָּרַ֖ע נַחֲלָתָֽן׃
36:4 And even when the Israelites observe the jubilee, their share will be added to that of the tribe into which they marry, and their share will be cut off from the ancestral portion of our tribe.”
36:4 And when the jubilee of the children of Israel shall be, then will their inheritance be added unto the inheritance of the tribe whereunto they shall belong; so will their inheritance be taken away from the inheritance of the tribe of our fathers.’
ל"ו:ד׳ וְאִם יְהֵי יוֹבְלָא לִבְנֵי יִשְׂרָאֵל וְתִתּוֹסַף אַחֲסַנְתְּהוֹן עַל אַחֲסָנַת שִׁבְטָא דִּי תְהֶוְיַן לְהוֹן וּמֵאַחֲסָנַת שִׁבְטָא דַאֲבְהָתָנָא יִתִּמְנַע אַחֲסַנְתְּהֶן:
ל"ו:ה׳ וַיְצַ֤ו מֹשֶׁה֙ אֶת־בְּנֵ֣י יִשְׂרָאֵ֔ל עַל־פִּ֥י יְהוָ֖ה לֵאמֹ֑ר כֵּ֛ן מַטֵּ֥ה בְנֵֽי־יוֹסֵ֖ף דֹּבְרִֽים׃
36:5 So Moses, at the LORD’s bidding, instructed the Israelites, saying: “The plea of the Josephite tribe is just.
36:5 And Moses commanded the children of Israel according to the word of the LORD, saying: ‘The tribe of the sons of Joseph speaketh right.
ל"ו:ה׳ וּפַקִּיד משֶׁה יָת בְּנֵי יִשְׂרָאֵל עַל מֵימְרָא דַיְיָ לְמֵימָר יָאוּת שִׁבְטָא דִבְנֵי יוֹסֵף מְמַלְּלִין:
ל"ו:ה׳ אור החיים
1וַיְצַו מֹשֶׁה אֶת בְּנֵי יִשְׂרָאֵל וְגוֹ׳. פֵּרוּשׁ, שֶׁצִּוָּה אוֹתָם עַל פִּי ה׳ שֶׁצִּוָּהוּ לֵאמֹר לְיִשְׂרָאֵל, וּמַה צִּוָּה? ״כֵּן מַטֵּה בְנֵי יוֹסֵף״ וְגוֹ׳, פֵּרוּשׁ, שֶׁבָּאָה הַמִּצְוָה מֵה׳ שֶׁטַּעֲנָתָם וְדִבְרֵיהֶם אֱמֶת, וְהַכַּוָּנָה בָּזֶה לְכָבוֹד וּלְתִפְאֶרֶת בְּנֵי יוֹסֵף.
ויצו משה את בני ישראל, Moses commanded the children of Israel, etc. The meaning of the verse is that Moses commanded them at the behest of G'd who had commanded him to address the children of Israel. What was the content of that command? "The tribes of the sons of Joseph are correct in what they are saying." The whole verse is a compliment to the tribes of Ephrayim and Menashe.
ל"ו:ו׳ זֶ֣ה הַדָּבָ֞ר אֲשֶׁר־צִוָּ֣ה יְהוָ֗ה לִבְנ֤וֹת צְלָפְחָד֙ לֵאמֹ֔ר לַטּ֥וֹב בְּעֵינֵיהֶ֖ם תִּהְיֶ֣ינָה לְנָשִׁ֑ים אַ֗ךְ לְמִשְׁפַּ֛חַת מַטֵּ֥ה אֲבִיהֶ֖ם תִּהְיֶ֥ינָה לְנָשִֽׁים׃
36:6 This is what the LORD has commanded concerning the daughters of Zelophehad: They may marry anyone they wish, provided they marry into a clan of their father’s tribe.
36:6 This is the thing which the LORD hath commanded concerning the daughters of Zelophehad, saying: Let them be married to whom they think best; only into the family of the tribe of their father shall they be married.

1זֶה הַדָּבָר. אָמְרוֹ זֶה הַדָּבָר, יִתְבָּאֵר עַל פִּי מַה שֶׁאָמְרוּ בְּמַסֶּכֶת בָּבָא בַּתְרָא (קכ.) וְזֶה לְשׁוֹנָם: בְּנוֹת צְלָפְחָד הוּתְּרוּ לִנָּשֵׂא לְכָל מִי שֶׁיִּרְצוּ, שֶׁנֶּאֱמַר ״לַטּוֹב בְּעֵינֵיהֶם״, אֶלָּא מָה אֲנִי מְקַיֵּם ״אַךְ לְמִשְׁפַּחַת אֲבִיהֶן״ וְגוֹ׳ – עֵצָה טוֹבָה וְכוּ׳, עַד כָּאן. וְהוּא אָמְרוֹ זֶה הַדָּבָר, פֵּרוּשׁ, לְפִי שֶׁקָּדַם וְאָמַר ״כֵּן מַטֵּה בְנֵי יוֹסֵף דּוֹבְרִים״ שֶׁהַדִּין עִמָּם, וְחָזַר וּפֵרַשׁ שֶׁדִּין זֶה שֶׁל בְּנוֹת צְלָפְחָד לֹא נִכְלַל בְּגֶדֶר גְּזֵרַת מִשְׁפָּט זֶה, וְהוּא אָמְרוֹ זֶה הַדָּבָר אֲשֶׁר צִוָּה ה׳ לִבְנוֹת צְלָפְחָד שֶׁהָרְשׁוּת בְּיָדָם לַטּוֹב בְּעֵינֵיהֶם וְגוֹ׳. וְדִקְדֵּק לוֹמַר ״זֶה״ לוֹמַר וְלֹא אַחֵר, שֶׁלֹּא עָשָׂה ה׳ מַעֲלָה זוֹ בְּרִשְׁיוֹן זֶה אֶלָּא לָהֶם, וְהוּא מַה שֶׁרָמַז בְּאָמְרוֹ בְּנוֹת צְלָפְחָד לֵאמֹר שֶׁאֵין לְתֵבַת ״לֵאמֹר״ מַשְׁמָעוּת, וּלְדַרְכֵּנוּ יְכַוֵּן לוֹמַר כִּי בָא הָאֱלֹהִים בְּמַאֲמָר זֶה לְרוֹמֵם כְּבוֹדָם.
זה הדבר, "this is the thing, etc." This expression is explained in Baba Batra 120 as follows: "the daughters of Tzelofchod were permitted free choice of husbands, including husbands who were from different tribes, as it says in our verse לטוב בעיניהם תהיינה לנשים, 'let them be married to whom they think best;'" the question then arises how we can can reconcile this with the words "but let them be married to members of the tribe of their father?" The Talmud answers that these words are not a condition but merely sound advice by the Torah to these girls. Thus far the Talmud. When the Torah said זה הדבר these words were necessary because what preceded them was the Torah's acknowledgment that legally speaking the tribes of Joseph had a sound claim. The Torah therefore had to go on record that the justice of the claim of the tribes of Joseph extended to other daughters inheriting land through their fathers which might become lost to their tribe if such daughters married someone out of their tribe and the Jubilee regulation might alienate such land to the original tribe forever. However, in this single instance of the daughters of Tzelofchod, the general rule did not apply and these daughters were free to be married to men of their choosing even men outside their tribes. The word זה is restrictive and makes an exception of the daughters of Tzelofchod. This is also alluded to in the unnecessary word לאמור in this verse. G'd went out of His way to pay great honour to these girls.
ל"ו:ז׳ וְלֹֽא־תִסֹּ֤ב נַחֲלָה֙ לִבְנֵ֣י יִשְׂרָאֵ֔ל מִמַּטֶּ֖ה אֶל־מַטֶּ֑ה כִּ֣י אִ֗ישׁ בְּנַחֲלַת֙ מַטֵּ֣ה אֲבֹתָ֔יו יִדְבְּק֖וּ בְּנֵ֥י יִשְׂרָאֵֽל׃
36:7 No inheritance of the Israelites may pass over from one tribe to another, but the Israelites must remain bound each to the ancestral portion of his tribe.
36:7 So shall no inheritance of the children of Israel remove from tribe to tribe; for the children of Israel shall cleave every one to the inheritance of the tribe of his fathers.
ל"ו:ז׳ וְלָא תַסְחַר אַחֲסָנָא לִבְנֵי יִשְׂרָאֵל מִשִּׁבְטָא לְשִׁבְטָא אֲרֵי גְבַר בְּאַחֲסָנַת שִׁבְטָא דַאֲבָהָתוֹהִי יִדַּבְּקוּן בְּנֵי יִשְׂרָאֵל:
ל"ו:ח׳ וְכָל־בַּ֞ת יֹרֶ֣שֶׁת נַחֲלָ֗ה מִמַּטּוֹת֮ בְּנֵ֣י יִשְׂרָאֵל֒ לְאֶחָ֗ד מִמִּשְׁפַּ֛חַת מַטֵּ֥ה אָבִ֖יהָ תִּהְיֶ֣ה לְאִשָּׁ֑ה לְמַ֗עַן יִֽירְשׁוּ֙ בְּנֵ֣י יִשְׂרָאֵ֔ל אִ֖ישׁ נַחֲלַ֥ת אֲבֹתָֽיו׃
36:8 Every daughter among the Israelite tribes who inherits a share must marry someone from a clan of her father’s tribe, in order that every Israelite may keep his ancestral share.
36:8 And every daughter, that possesseth an inheritance in any tribe of the children of Israel, shall be wife unto one of the family of the tribe of her father, that the children of Israel may possess every man the inheritance of his fathers.
ל"ו:ח׳ וְכָל בְּרַתָּא יָרְתַת אַחֲסָנָא מִשִּׁבְטַיָּא דִּבְנֵי יִשְׂרָאֵל לְחַד מִזַּרְעִית שִׁבְטָא דַאֲבוּהָא תְּהֵי לְאִנְתּוּ בְּדִיל דִּי יֵרְתוּן בְּנֵי יִשְׂרָאֵל גְּבַר אַחֲסָנַת אֲבָהָתוֹהִי:
ל"ו:ט׳ וְלֹֽא־תִסֹּ֧ב נַחֲלָ֛ה מִמַּטֶּ֖ה לְמַטֶּ֣ה אַחֵ֑ר כִּי־אִישׁ֙ בְּנַ֣חֲלָת֔וֹ יִדְבְּק֕וּ מַטּ֖וֹת בְּנֵ֥י יִשְׂרָאֵֽל׃
36:9 Thus no inheritance shall pass over from one tribe to another, but the Israelite tribes shall remain bound each to its portion.”
36:9 So shall no inheritance remove from one tribe to another tribe; for the tribes of the children of Israel shall cleave each one to its own inheritance.’

1וְלֹא תִסֹּב נַחֲלָה מִמַּטֶּה וְגוֹ׳. טַעַם שֶׁכָּפַל הַמַּאֲמָר עַצְמוֹ שֶׁאָמַר בְּסָמוּךְ ״וְלֹא תִסֹּב״ וְגוֹ׳, לְפִי מַה שֶׁכָּתַבְתִּי בְּסָמוּךְ שֶׁאֵין זֶה אֶלָּא עֵצָה טוֹבָה, בָּא מַאֲמָר שֵׁנִי לְחִיּוּב לְכָל בְּנֵי יִשְׂרָאֵל שֶׁאֲלֵיהֶם בָּאָה מִצְוַת ״וְכָל בַּת יוֹרֶשֶׁת״ וְגוֹ׳ הָאֲמוּרָה קֹדֶם לָזֶה.
ולא תסב נחלה, "so that an inheritance not move (from one tribe to another), etc. The reason the Torah repeats this both negatively and positively is as I have explained already that it was only well meant advice not legislation. The Torah therefore had to repeat that in all instances other than the daughters of Tzelofchod this was a matter of legislation.
ל"ו:י׳ כַּאֲשֶׁ֛ר צִוָּ֥ה יְהוָ֖ה אֶת־מֹשֶׁ֑ה כֵּ֥ן עָשׂ֖וּ בְּנ֥וֹת צְלָפְחָֽד׃
36:10 The daughters of Zelophehad did as the LORD had commanded Moses:
36:10 Even as the LORD commanded Moses, so did the daughters of Zelophehad.
ל"ו:י׳ כְּמָא דִי פַּקִּיד יְיָ יָת משֶׁה כֵּן עֲבָדוּ בְּנַת צְלָפְחָד:

1כַּאֲשֶׁר צִוָּה ה׳ אֶת מֹשֶׁה כֵּן עָשׂוּ. צָרִיךְ לָדַעַת לָמָּה שִׁנָּה הַכָּתוּב מַאֲמָר זֶה מִסֵּדֶר הָרָגִיל שֶׁמַּקְדִּים הַמַּעֲשֶׂה וְאַחַר כָּךְ יֹאמַר ״כַּאֲשֶׁר צִוָּה״, וְכָאן הִקְדִּים מַאֲמַר כַּאֲשֶׁר וְגוֹ׳ וְאַחַר כָּךְ אָמַר כֵּן עָשׂוּ?
כאשר צוה ה׳ את משה כן עשו, "they did as G'd had commanded Moses." We have to understand why the Torah departed from its usual syntax of first reporting the execution and subsequently the fact that it corresponded to the command, whereas here the Torah reverses the order by writing כן עשו only at the end of the verse.
2וְנִרְאֶה כִּי לְפִי שֶׁה׳ עָשָׂה לָהֶם יִתְרוֹן לִבְנוֹת צְלָפְחָד וּמַעֲלָה וְהִתִּיר לָהֶם לִנָּשֵׂא לְכָל אָדָם וְהוֹצִיאָם מִכְּלַל מִצְוָה הַכְּלָלִית, בָּא הַכָּתוּב לְהוֹדִיעֵנוּ שֶׁהֲגַם שֶׁה׳ עָשָׂה הַבְּחִירָה בְּיָדָם, אַף עַל פִּי כֵן לֹא עָשׂוּ אֶלָּא כְּמִצְוַת הַמֶּלֶךְ לְעַם בְּנֵי יִשְׂרָאֵל, וְהוּא אָמְרוֹ כַּאֲשֶׁר צִוָּה וְגוֹ׳, פֵּרוּשׁ כַּמִּצְוָה הַכְּלָלִית כֵּן עָשׂוּ וְלֹא כָּרִשְׁיוֹן שֶׁנָּתַן לָהֶם. וְלָזֶה אִם הָיָה אוֹמֵר ״וַיַּעֲשׂוּ בְּנוֹת צְלָפְחָד וְגוֹ׳ כַּאֲשֶׁר צִוָּה״ יִהְיֶה נִשְׁמָע שֶׁהַהוֹדָעָה בָּאָה לוֹמַר הַמַּעֲשֶׂה שֶׁעָשׂוּ, וּמוֹדִיעַ בְּמַאֲמַר ״כַּאֲשֶׁר צִוָּה ה׳״ כַּסֵּדֶר הָרָגִיל לוֹמַר, אֲבָל מֵאָמְרוֹ בַּתְּחִלָּה כַּאֲשֶׁר צִוָּה ה׳ וְאַחַר כָּךְ הוֹדָעַת הַמַּעֲשֶׂה, זֶה יַגִּיד כִּי לֹא בָּא לְהוֹדִיעַ הַמַּעֲשֶׂה אֶלָּא לִשְׁלֹל רִשְׁיוֹן הֵפֶךְ מִצְוָה הַכְּלָלִית, וְהָבֵן:
It appears that the reason is that seeing that in this case the Torah had made an exception and allowed the daughters of Tzelofchod free choice in their marriage partners, the Torah wanted us to know that the daughters of Tzelofchod did not take advantage of the special latitude which G'd had granted to them but abided by the general rule laid down for future generations and married within their tribe. The words כאשר צוה השם refer to what G'd had commanded to daughters in the future who would inherit their father's estate. These girls did not take advantage of the special permission granted to them. Had the Torah used its usual syntax here all we would have learned from the verse would have been that the daughters of Tzelofchod did not contravene G'd's command.

36:11 Mahlah, Tirzah, Hoglah, Milcah, and Noah, Zelophehad’s daughters, were married to sons of their uncles,
36:11 For Mahlah, Tirzah, and Hoglah, and Milcah, and Noah, the daughters of Zelophehad, were married unto their father’s brothers’sons.
ל"ו:י"א וַהֲוָאָה מַחְלָה תִרְצָה וְחָגְלָה וּמִלְכָּה וְנֹעָה בְּנַת צְלָפְחָד לִבְנֵי אֲחֵי אֲבוּהֶן לִנְשִׁין:
ל"ו:י"ב מִֽמִּשְׁפְּחֹ֛ת בְּנֵֽי־מְנַשֶּׁ֥ה בֶן־יוֹסֵ֖ף הָי֣וּ לְנָשִׁ֑ים וַתְּהִי֙ נַחֲלָתָ֔ן עַל־מַטֵּ֖ה מִשְׁפַּ֥חַת אֲבִיהֶֽן׃
36:12 marrying into clans of descendants of Manasseh son of Joseph; and so their share remained in the tribe of their father’s clan.
36:12 They were married into the families of the sons of Manasseh the son of Joseph, and their inheritance remained in the tribe of the family of their father.
ל"ו:י"ב מִזַרְעֲיַת בְּנֵי מְנַשֶּׁה בַר יוֹסֵף הֲוָאָה לִנְשִׁין וַהֲוַת אַחֲסַנְתְּהֶן עַל שִׁבְטָא זַרְעִית אַבוּהֶן:
ל"ו:י"ג אֵ֣לֶּה הַמִּצְוֺ֞ת וְהַמִּשְׁפָּטִ֗ים אֲשֶׁ֨ר צִוָּ֧ה יְהוָ֛ה בְּיַד־מֹשֶׁ֖ה אֶל־בְּנֵ֣י יִשְׂרָאֵ֑ל בְּעַֽרְבֹ֣ת מוֹאָ֔ב עַ֖ל יַרְדֵּ֥ן יְרֵחֽוֹ׃
36:13 These are the commandments and regulations that the LORD enjoined upon the Israelites, through Moses, on the steppes of Moab, at the Jordan near Jericho.
36:13 These are the commandments and the ordinances, which the LORD commanded by the hand of Moses unto the children of Israel in the plains of Moab by the Jordan at Jericho.
