וַיְדַבֵּ֥ר יְהוָ֖ה אֶל־מֹשֶׁ֥ה לֵּאמֹֽר׃

The LORD spoke further to Moses:

And the LORD spoke unto Moses, saying:

וּמַלִּיל יְיָ עִם משֶׁה לְמֵימָר:
ל"ה:י׳
דַּבֵּר֙ אֶל־בְּנֵ֣י יִשְׂרָאֵ֔ל וְאָמַרְתָּ֖ אֲלֵהֶ֑ם כִּ֥י אַתֶּ֛ם עֹבְרִ֥ים אֶת־הַיַּרְדֵּ֖ן אַ֥רְצָה כְּנָֽעַן׃
35:10
Speak to the Israelite people and say to them: When you cross the Jordan into the land of Canaan,

’Speak unto the children of Israel, and say unto them: When ye pass over the Jordan into the land of Canaan,

מַלֵּל עִם בְּנֵי יִשְׂרָאֵל וְתֵימַר לְהוֹן אֲרֵי אַתּוּן עָבְרִין יָת יַרְדְּנָא לְאַרְעָא דִכְנָעַן:

וְהִקְרִיתֶ֤ם לָכֶם֙ עָרִ֔ים עָרֵ֥י מִקְלָ֖ט תִּהְיֶ֣ינָה לָכֶ֑ם וְנָ֥ס שָׁ֙מָּה֙ רֹצֵ֔חַ מַכֵּה־נֶ֖פֶשׁ בִּשְׁגָגָֽה׃
35:11
you shall provide yourselves with places to serve you as cities of refuge to which a manslayer who has killed a person unintentionally may flee.
35:11
then ye shall appoint you cities to be cities of refuge for you, that the manslayer that killeth any person through error may flee thither.

וּתְזַמְּנוּן לְכוֹן קִרְוִין קִרְוֵי שֵׁזָבוּתָא יֶהֶוְיַן לְכוֹן וְיֵעֲרוֹק לְתַמָּן קָטוֹלָא דְּיִקְטוֹל נַפְשָׁא בְּשָׁלוּ:
והקריתם. אֵין הַקְרָיָה אֶלָּא לְשׁוֹן הַזְמָנָה, וְכֵן הוּא אוֹמֵר "כִּי הִקְרָה ה' אֱלֹהֶיךָ לְפָנָי" (בראשית כ"ז):

וְהָי֨וּ לָכֶ֧ם הֶעָרִ֛ים לְמִקְלָ֖ט מִגֹּאֵ֑ל וְלֹ֤א יָמוּת֙ הָרֹצֵ֔חַ עַד־עָמְד֛וֹ לִפְנֵ֥י הָעֵדָ֖ה לַמִּשְׁפָּֽט׃
35:12
The cities shall serve you as a refuge from the avenger,aLit. “redeemer,” i.e., next of kin; cf. note at Lev. 25.25. so that the manslayer may not die unless he has stood trial before the assembly.
35:12
And the cities shall be unto you for refuge from the avenger, that the manslayer die not, until he stand before the congregation for judgment.

וִיהוֹן לְכוֹן קִרְוַיָּא לְשֵׁזָבָא מִגָּאֵל דְּמָא וְלָא יְמוּת קָטוֹלָא עַד דְּיֵקוּם קֳדָם כְּנִשְׁתָּא לְדִינָא:
מגאל. מִפְּנֵי גּוֹאֵל הַדָּם, שֶׁהוּא קָרוֹב לַנִּרְצָח:

וְהֶעָרִ֖ים אֲשֶׁ֣ר תִּתֵּ֑נוּ שֵׁשׁ־עָרֵ֥י מִקְלָ֖ט תִּהְיֶ֥ינָה לָכֶֽם׃

The towns that you thus assign shall be six cities of refuge in all.
35:13
And as to the cities which ye shall give, there shall be for you six cities of refuge.

שש ערי מקלט. מַגִּיד שֶׁאַעַ"פִּ שֶׁהִבְדִּיל מֹשֶׁה בְּחַיָּיו שָׁלוֹשׁ עָרִים בְּעֵבֶר הַיַּרְדֵּן, לֹא הָיוּ קוֹלְטוֹת עַד שֶׁנִּבְחֲרוּ שָׁלֹשׁ שֶׁנָּתַן יְהוֹשֻׁעַ בְּאֶרֶץ כְּנַעַן (ספרי; מכות ט'):

אֵ֣ת ׀ שְׁלֹ֣שׁ הֶעָרִ֗ים תִּתְּנוּ֙ מֵעֵ֣בֶר לַיַּרְדֵּ֔ן וְאֵת֙ שְׁלֹ֣שׁ הֶֽעָרִ֔ים תִּתְּנ֖וּ בְּאֶ֣רֶץ כְּנָ֑עַן עָרֵ֥י מִקְלָ֖ט תִּהְיֶֽינָה׃

Three cities shall be designated beyond the Jordan, and the other three shall be designated in the land of Canaan: they shall serve as cities of refuge.

יָת תְּלַת קִרְוַיָּא תִּתְּנוּן מֵעִבְרָא לְיַרְדְּנָא וְיָת תְּלַת קִרְוַיָּא תִּתְּנוּן בְּאַרְעָא דִכְנָעַן קִרְוֵי שֵׁזָבוּתָא יֶהֶוְיָן:
את שלש הערים וגו'. אַעַ"פִּ שֶׁבְּאֶרֶץ כְּנַעַן תִּשְׁעָה שְׁבָטִים וְכָאן אֵינָן אֶלָּא שְׁנַיִם וָחֵצִי, הִשְׁוָה מִנְיַן עָרֵי הַמִּקְלָט שֶׁלָּהֶם, מִשּׁוּם דִּבְגִלְעָד נְפִישֵׁי רוֹצְחִים, דִּכְתִיב (הושע ו') "גִּלְעָד קִרְיַת פֹּעֲלֵי אָוֶן עֲקֻבָּה מִדָּם" (שם):

לִבְנֵ֣י יִשְׂרָאֵ֗ל וְלַגֵּ֤ר וְלַתּוֹשָׁב֙ בְּתוֹכָ֔ם תִּהְיֶ֛ינָה שֵׁשׁ־הֶעָרִ֥ים הָאֵ֖לֶּה לְמִקְלָ֑ט לָנ֣וּס שָׁ֔מָּה כָּל־מַכֵּה־נֶ֖פֶשׁ בִּשְׁגָגָֽה׃
35:15
These six cities shall serve the Israelites and the resident aliens among them for refuge, so that anyone who kills a person unintentionally may flee there.
35:15
For the children of Israel, and for the stranger and for the settler among them, shall these six cities be for refuge, that every one that killeth any person through error may flee thither.

וְאִם־בִּכְלִ֨י בַרְזֶ֧ל ׀ הִכָּ֛הוּ וַיָּמֹ֖ת רֹצֵ֣חַֽ ה֑וּא מ֥וֹת יוּמַ֖ת הָרֹצֵֽחַ׃
35:16
Anyone, however, who strikes another with an iron object so that death results is a murderer; the murderer must be put to death.
35:16
But if he smote him with an instrument of iron, so that he died, he is a murderer; the murderer shall surely be put to death.

וְאִם בְּמָאן דְפַרְזְלָא מְחָהִי וְקָטְלֵיהּ קָטוֹלָא הוּא אִתְקְטָלָא יִתְקְטֵל קָטוֹלָא:
ואם בכלי ברזל הכהו. אֵין זֶה מְדַבֵּר בְּהוֹרֵג בְּשׁוֹגֵג הַסָּמוּךְ לוֹ, אֶלָּא בְּהוֹרֵג בְּמֵזִיד, וּבָא לְלַמֵּד שֶׁהַהוֹרֵג בְּכָל דָּבָר צָרִיךְ שֶׁיְּהֵא בוֹ שִׁעוּר כְּדֵי לְהָמִית, שֶׁנֶּאֱמַר בְּכֻלָּם "אֲשֶׁר יָמוּת בּוֹ", דִּמְתַּרְגְּמִינַן "דְּהִיא כְמִסַּת דִּימוּת בֵּיהּ", חוּץ מִן הַבַּרְזֶל, שֶׁגָּלוּי וְיָדוּעַ לִפְנֵי הַקָּבָּ"ה שֶׁהַבַּרְזֶל מֵמִית בְּכָל שֶׁהוּא, אֲפִלּוּ מַחַט, לְפִיכָךְ לֹא נָתְנָה בוֹ תּוֹרָה שִׁעוּר לִכְתֹּב בּוֹ אֲשֶׁר יָמוּת בּוֹ; וְאִם תֹּאמַר בְּהוֹרֵג בְּשׁוֹגֵג הַכָּתוּב מְדַבֵּר, הֲרֵי הוּא אוֹמֵר לְמַטָּה אוֹ בכל אבן אשר ימות בה בלא ראות וְגוֹ', לִמֵּד עַל הָאֲמוּרִים לְמַעְלָה שֶׁבְּהוֹרֵג בְּמֵזִיד הַכָּתוּב מְדַבֵּר:

וְאִ֡ם בְּאֶ֣בֶן יָד֩ אֲשֶׁר־יָמ֨וּת בָּ֥הּ הִכָּ֛הוּ וַיָּמֹ֖ת רֹצֵ֣חַֽ ה֑וּא מ֥וֹת יוּמַ֖ת הָרֹצֵֽחַ׃
35:17
If he struck him with a stone toolbLit. “of the hand.” that could cause death, and death resulted, he is a murderer; the murderer must be put to death.
35:17
And if he smote him with a stone in the hand, whereby a man may die, and he died, he is a murderer; the murderer shall surely be put to death.

וְאִם בְּאַבְנָא דְּמִתְנָסְבָא בִידָא דְּהִיא כְמִסַּת דִּי יְמוּת בַּהּ מְחָהִי וְקָטְלֵיהּ קָטוֹלָא הוּא אִתְקְטָלָא יִתְקְטֵל קָטוֹלָא:
באבן יד. שֶׁיֵּשׁ בָּהּ מְלֹא יָד (ספרי):
אשר ימות בה. שֶׁיֵּשׁ בָּהּ שִׁעוּר לְהָמִית, כְּתַרְגּוּמוֹ; לְפִי שֶׁנֶּאֱמַר "וְהִכָּה אִישׁ אֶת רֵעֵהוּ בְּאֶבֶן" (שמות כ"א), וְלֹא נָתַן בָּהּ שִׁעוּר, יָכוֹל כָּל שֶׁהוּא, לְכָךְ נֶאֱמַר אשר ימות בה:

א֡וֹ בִּכְלִ֣י עֵֽץ־יָד֩ אֲשֶׁר־יָמ֨וּת בּ֥וֹ הִכָּ֛הוּ וַיָּמֹ֖ת רֹצֵ֣חַֽ ה֑וּא מ֥וֹת יוּמַ֖ת הָרֹצֵֽחַ׃
35:18
Similarly, if the object with which he struck him was a wooden toolbLit. “of the hand.” that could cause death, and death resulted, he is a murderer; the murderer must be put to death.
35:18
Or if he smote him with a weapon of wood in the hand, whereby a man may die, and he died, he is a murderer; the murderer shall surely be put to death.

אוֹ בְּמָאן דְּעָא דְּמִתְנַסֵב בִּידָא דְּהִיא כְמִסַּת דִּי יְמוּת בֵּיהּ מְחָהִי וְקָטְלֵיהּ קָטוֹלָא הוּא אִתְקְטָלָא יִתְקְטַל קָטוֹלָא:
או בכלי עץ יד. לְפִי שֶׁנֶּאֱמַר (שם) "וְכִי יַכֶּה אִישׁ אֶת עַבְדּוֹ אוֹ אֶת אֲמָתוֹ בַּשֵּׁבֶט", יָכוֹל כָּל שֶׁהוּא, לְכָךְ נֶאֱמַר "בְּעֵץ אֲשֶׁר יָמוּת בּוֹ" — שֶׁיְּהֵא בּוֹ כְּדֵי לְהָמִית (ספרי):

גֹּאֵ֣ל הַדָּ֔ם ה֥וּא יָמִ֖ית אֶת־הָרֹצֵ֑חַ בְּפִגְעוֹ־ב֖וֹ ה֥וּא יְמִיתֶֽנּוּ׃
35:19
The blood-avenger himself shall put the murderer to death; it is he who shall put him to death upon encounter.
35:19
The avenger of blood shall himself put the murderer to death; when he meeteth him, he shall put him to death.

גָּאֵל דְּמָא הוּא יִקְטוֹל יָת קָטוֹלָא כַּד אִתְחַיַּב לֵיהּ מִן דִּינָא הוּא יִקְטְלִנֵּיהּ:
בפגעו בו. אֲפִלּוּ בְּתוֹךְ עָרֵי מִקְלָט:

וְאִם־בְּשִׂנְאָ֖ה יֶהְדָּפֶ֑נּוּ אֽוֹ־הִשְׁלִ֥יךְ עָלָ֛יו בִּצְדִיָּ֖ה וַיָּמֹֽת׃
35:20
So, too, if he pushed him in hate or hurled something at him on purpose and death resulted,

And if he thrust him of hatred, or hurled at him any thing, lying in wait, so that he died;

וְאִם בְּסַנְאָה דְּחָהִי אוֹ רְמָא עֲלוֹהִי בְכַמְנָא וְקָטְלֵיהּ:
בצדיה. כְּתַרְגּוּמוֹ, "בְּכָמְנָא" — בְּמַאֲרָב:

א֣וֹ בְאֵיבָ֞ה הִכָּ֤הוּ בְיָדוֹ֙ וַיָּמֹ֔ת מֽוֹת־יוּמַ֥ת הַמַּכֶּ֖ה רֹצֵ֣חַֽ ה֑וּא גֹּאֵ֣ל הַדָּ֗ם יָמִ֛ית אֶת־הָרֹצֵ֖חַ בְּפִגְעוֹ־בֽוֹ׃
35:21
or if he struck him with his hand in enmity and death resulted, the assailant shall be put to death; he is a murderer. The blood-avenger shall put the murderer to death upon encounter.
35:21
or in enmity smote him with his hand, that he died; he that smote him shall surely be put to death: he is a murderer; the avenger of blood shall put the murderer to death when he meeteth him.

But if he pushed him without malice aforethought or hurled any object at him unintentionally,

וְאִם בִּתְכֵף בְּלָא דְבָבוּ דְּחָהִי אוֹ רְמָא עֲלוֹהִי כָּל מָאן בְּלָא כְמַן לֵיהּ:
בפתע. בְּאֹנֶס, וְתַרְגּוּמוֹ "בִּתְכֵיף", שֶׁהָיָה סָמוּךְ לוֹ וְלֹא הָיָה לוֹ שָׁהוּת לְהִזָּהֵר עָלָיו:

א֣וֹ בְכָל־אֶ֜בֶן אֲשֶׁר־יָמ֥וּת בָּהּ֙ בְּלֹ֣א רְא֔וֹת וַיַּפֵּ֥ל עָלָ֖יו וַיָּמֹ֑ת וְהוּא֙ לֹא־אוֹיֵ֣ב ל֔וֹ וְלֹ֥א מְבַקֵּ֖שׁ רָעָתֽוֹ׃
35:23
or inadvertentlycLit. “without seeing.” dropped upon him any deadly object of stone, and death resulted—though he was not an enemy of his and did not seek his harm—

or with any stone, whereby a man may die, seeing him not, and cast it upon him, so that he died, and he was not his enemy, neither sought his harm;

אוֹ בְכָל אַבְנָא דְּהִיא כְמִסַּת דִּי יְמוּת בַּהּ בְּלָא חָזֵי וּרְמָא עֲלוֹהִי וְקָטְלֵיהּ וְהוּא לָא סָנֵי לֵיהּ וְלָא תָבַע בִּישְׁתֵּיהּ:
או בכל אבן אשר ימות בה. הִכָּהוּ:
בלא ראות. שֶׁלֹּא רָאָהוּ:
ויפל עליו. מִכָּאן אָמְרוּ הַהוֹרֵג דֶּרֶךְ יְרִידָה גּוֹלֶה, דֶּרֶךְ עֲלִיָּה אֵינוֹ גוֹלֶה (מכות ל'):

וְשָֽׁפְטוּ֙ הָֽעֵדָ֔ה בֵּ֚ין הַמַּכֶּ֔ה וּבֵ֖ין גֹּאֵ֣ל הַדָּ֑ם עַ֥ל הַמִּשְׁפָּטִ֖ים הָאֵֽלֶּה׃
35:24
in such cases the assembly shall decide between the slayer and the blood-avenger.
35:24
then the congregation shall judge between the smiter and the avenger of blood according to these ordinances;

וִידוּנוּן כְּנִשְׁתָּא בֵּין מַחֲיָא וּבֵין גָּאֵל דְּמָא עַל דִּינַיָּא הָאִלֵּין:

וְהִצִּ֨ילוּ הָעֵדָ֜ה אֶת־הָרֹצֵ֗חַ מִיַּד֮ גֹּאֵ֣ל הַדָּם֒ וְהֵשִׁ֤יבוּ אֹתוֹ֙ הָֽעֵדָ֔ה אֶל־עִ֥יר מִקְלָט֖וֹ אֲשֶׁר־נָ֣ס שָׁ֑מָּה וְיָ֣שַׁב בָּ֗הּ עַד־מוֹת֙ הַכֹּהֵ֣ן הַגָּדֹ֔ל אֲשֶׁר־מָשַׁ֥ח אֹת֖וֹ בְּשֶׁ֥מֶן הַקֹּֽדֶשׁ׃
35:25
The assembly shall protect the manslayer from the blood-avenger, and the assembly shall restore him to the city of refuge to which he fled, and there he shall remain until the death of the high priest who was anointed with the sacred oil.

and the congregation shall deliver the manslayer out of the hand of the avenger of blood, and the congregation shall restore him to his city of refuge, whither he was fled; and he shall dwell therein until the death of the high priest, who was anointed with the holy oil.

וִישֵׁזְבוּן כְּנִשְׁתָּא יָת קָטוֹלָא מִיַּד גָּאֵל דְּמָא וִיתִיבוּן יָתֵיהּ כְּנִשְׁתָּא לְקִרְיַת שֵׁזָבוּתֵיהּ דִּי עֲרַק לְתַמָּן וִיתֵב בַּהּ עַד דִּימוּת כַּהֲנָא רַבָּא דִּי רַבִּי יָתֵיהּ בִּמְשַׁח קוּדְשָׁא:
עד מות הכהן הגדול. שֶׁהוּא בָא לְהַשְׁרוֹת שְׁכִינָה בְיִשְׂרָאֵל וּלְהַאֲרִיךְ יְמֵיהֶם, וְהָרוֹצֵחַ בָּא לְסַלֵּק אֶת הַשְּׁכִינָה מִיִּשְׂרָאֵל וּמְקַצֵּר אֶת יְמֵי הַחַיִּים, אֵינוֹ כְדַאי שֶׁיְּהֵא לִפְנֵי כֹּהֵן גָּדוֹל (ספרי); דָּבָר אַחֵר — לְפִי שֶׁהָיָה לוֹ לְכֹהֵן גָּדוֹל לְהִתְפַּלֵּל שֶׁלֹּא תֶאֱרַע תַּקָּלָה זוֹ לְיִשְׂרָאֵל בְּחַיָּיו (עי' מכות י"א):
אשר משח אותו בשמן הקדש. לְפִי פְשׁוּטוֹ מִן הַמִּקְרָאוֹת הַקְּצָרִים הוּא, שֶׁלֹּא פֵּרֵשׁ מִי מְשָׁחוֹ, אֶלָּא כְּמוֹ אֲשֶׁר מְשָׁחוֹ הַמּוֹשֵׁחַ אוֹתוֹ בְּשֶׁמֶן הַקֹּדֶשׁ; וְרַבּוֹתֵינוּ דְרָשׁוּהוּ בְמַסֶּכֶת מַכּוֹת (שם) לִרְאָיַת דָּבָר, לְלַמֵּד שֶׁאִם עַד שֶׁלֹּא נִגְמַר דִּינוֹ מֵת הַכֹּהֵן גָּדוֹל וּמִנּוּ אַחֵר תַּחְתָּיו, וּלְאַחַר מִכָּאן נִגְמַר דִּינוֹ, חוֹזֵר בְּמִיתָתוֹ שֶׁל שֵׁנִי, שֶׁנֶּאֱמַר אשר משח אתו, וְכִי הוּא מוֹשְׁחוֹ לַכֹּהֵן אוֹ הַכֹּהֵן מָשַׁח אוֹתוֹ? אֶלָּא לְהָבִיא אֶת הַנִּמְשָׁח בְּיָמָיו שֶׁמַּחֲזִירוֹ בְּמִיתָתוֹ:

וְאִם־יָצֹ֥א יֵצֵ֖א הָרֹצֵ֑חַ אֶת־גְּבוּל֙ עִ֣יר מִקְלָט֔וֹ אֲשֶׁ֥ר יָנ֖וּס שָֽׁמָּה׃
35:26
But if the manslayer ever goes outside the limits of the city of refuge to which he has fled,

But if the manslayer shall at any time go beyond the border of his city of refuge, whither he fleeth;

וְאִם מִפַּק יִפּוֹק קָטוֹלָא יָת תְּחוּם קִרְיַת שֵׁזָבוּתֵיהּ דִּי עֲרַק לְתַמָּן:
ל"ה:כ"ז
וּמָצָ֤א אֹתוֹ֙ גֹּאֵ֣ל הַדָּ֔ם מִח֕וּץ לִגְב֖וּל עִ֣יר מִקְלָט֑וֹ וְרָצַ֞ח גֹּאֵ֤ל הַדָּם֙ אֶת־הָ֣רֹצֵ֔חַ אֵ֥ין ל֖וֹ דָּֽם׃
35:27
and the blood-avenger comes upon him outside the limits of his city of refuge, and the blood-avenger kills the manslayer, there is no bloodguilt on his account.
35:27
and the avenger of blood find him without the border of his city of refuge, and the avenger of blood slay the manslayer; there shall be no bloodguiltiness for him;

וְיַשְׁכַּח יָתֵיהּ גָּאֵל דְּמָא מִבָּרָא לִתְחוּם קִרְיַת שֵׁזָבוּתֵיהּ וְיִקְטוֹל גָּאֵל דְּמָא יָת קָטוֹלָא לֵית לֵיהּ דְּמָא:
אין לו דם. הֲרֵי הוּא כְּהוֹרֵג אֶת הַמֵּת, שֶׁאֵין לוֹ דָּם:

For he must remain inside his city of refuge until the death of the high priest; after the death of the high priest, the manslayer may return to his land holding.

וְהָי֨וּ אֵ֧לֶּה לָכֶ֛ם לְחֻקַּ֥ת מִשְׁפָּ֖ט לְדֹרֹתֵיכֶ֑ם בְּכֹ֖ל מוֹשְׁבֹתֵיכֶֽם׃

Such shall be your law of procedure throughout the ages in all your settlements.

בכל מושבתיכם. לִמֵּד שֶׁתְּהֵא סַנְהֶדְרִין קְטַנָּה נוֹהֶגֶת בְּחוּצָה לָאָרֶץ כָּל זְמַן שֶׁנּוֹהֶגֶת בְּאֶרֶץ יִשְׂרָאֵל (מכות ז'):

כָּל־מַ֨כֵּה־נֶ֔פֶשׁ לְפִ֣י עֵדִ֔ים יִרְצַ֖ח אֶת־הָרֹצֵ֑חַ וְעֵ֣ד אֶחָ֔ד לֹא־יַעֲנֶ֥ה בְנֶ֖פֶשׁ לָמֽוּת׃
35:30
If anyone kills a person, the manslayer may be executed only on the evidence of witnesses; the testimony of a single witness against a person shall not suffice for a sentence of death.

לפי עדים ירצח. שֶׁיָּעִידוּ שֶׁבְּמֵזִיד וּבְהַתְרָאָה הֲרָגוֹ:

וְלֹֽא־תִקְח֥וּ כֹ֙פֶר֙ לְנֶ֣פֶשׁ רֹצֵ֔חַ אֲשֶׁר־ה֥וּא רָשָׁ֖ע לָמ֑וּת כִּי־מ֖וֹת יוּמָֽת׃
35:31
You may not accept a ransom for the life of a murderer who is guilty of a capital crime; he must be put to death.

Moreover ye shall take no ransom for the life of a murderer, that is guilty of death; but he shall surely be put to death.

וְלָא תְקַבְּלוּן מָמוֹן עַל אֱנַשׁ קָטוֹל דִּי הוּא חַיָּב לְמִקְטָל אֲרֵי אִתְקְטָלָא יִתְקְטֵל:
ולא תקחו כפר. לֹא יִפָּטֵר בְּמָמוֹן (כתובות ל"ז):

Nor may you accept ransom in lieu of flight to a city of refuge, enabling one to return to live on his land before the death of the priest.

And ye shall take no ransom for him that is fled to his city of refuge, that he should come again to dwell in the land, until the death of the priest.

וְלָא תְקַבְּלוּן מָמוֹן לְמֵעֲרוֹק לְקִרְיַת שֵׁזָבוּתֵיהּ לְמִתּוּב לְמִתַּב בְּאַרְעָא עַד דִּימוּת כַּהֲנָא:
ולא תקחו כפר לנוס אל עיר מקלטו. לְמִי שֶׁנָּס אֶל עִיר מִקְלָט, שֶׁהָרַג בְּשׁוֹגֵג, אֵינוֹ נִפְטָר מִגָּלוּת בְּמָמוֹן, לִתֵּן כֹּפֶר לשוב לשבת בארץ טֶרֶם יָמוּת הַכֹּהֵן (שם):
לנוס. כְּמוֹ לַנָּס, כְּמוֹ "שׁוּבֵי מִלְחָמָה" (מיכה ב') — שֶׁשָּׁבוּ מִן הַמִּלְחָמָה, וְכֵן "נוּגֵי מִמּוֹעֵד" (צפניה ג'), וְכֵן "כִּי מֻלִים הָיוּ" (יהושע ה'); כַּאֲשֶׁר תֹּאמַר שׁוּב עַל מִי שֶׁשָּׁב כְּבָר, וּמוּל עַל שֶׁמָּל כְּבָר, כֵּן תֹּאמַר לָנוּס עַל מִי שֶׁנָּס כְּבָר, וְקוֹרֵהוּ נוּס, כְּלוֹמַר מֻבְרָח. וְאִם תֹּאמַר לָנוּס — לִבְרֹחַ, וּתְפָרְשֵׁהוּ לֹא תִקְחוּ כֹפֶר לְמִי שֶׁיֵּשׁ לוֹ לִבְרֹחַ לְפָטְרוֹ מִן הַגָּלוּת (עי' ספרי), לֹא יָדַעְתִּי הֵיאַךְ יֹאמַר לָשׁוּב לָשֶׁבֶת בָּאָרֶץ, הֲרֵי עֲדַיִן לֹא נָס, וּמֵהֵיכָן יָשׁוּב?:

וְלֹֽא־תַחֲנִ֣יפוּ אֶת־הָאָ֗רֶץ אֲשֶׁ֤ר אַתֶּם֙ בָּ֔הּ כִּ֣י הַדָּ֔ם ה֥וּא יַחֲנִ֖יף אֶת־הָאָ֑רֶץ וְלָאָ֣רֶץ לֹֽא־יְכֻפַּ֗ר לַדָּם֙ אֲשֶׁ֣ר שֻׁפַּךְ־בָּ֔הּ כִּי־אִ֖ם בְּדַ֥ם שֹׁפְכֽוֹ׃
35:33
You shall not pollute the land in which you live; for blood pollutes the land, and the land can have no expiation for blood that is shed on it, except by the blood of him who shed it.

So ye shall not pollute the land wherein ye are; for blood, it polluteth the land; and no expiation can be made for the land for the blood that is shed therein, but by the blood of him that shed it.

וְלָא תְחַיְּבוּן יָת אַרְעָא דִּי אַתּוּן בַּהּ אֲרֵי דְמָא הוּא מְחַיַּב יָת אַרְעָא וּלְאַרְעָא לָא מִתְכַּפֵּר עַל דַּם זַכַּאי דְּאִתָּשַׁד בַּהּ אֶלָּהֵן בְּדַם אַשְׁדֵּיהּ:
ולא תחניפו. לֹא תַרְשִׁיעוּ, כְּתַרְגּוּמוֹ — "וְלָא תְחַיְבוּן":

וְלֹ֧א תְטַמֵּ֣א אֶת־הָאָ֗רֶץ אֲשֶׁ֤ר אַתֶּם֙ יֹשְׁבִ֣ים בָּ֔הּ אֲשֶׁ֥ר אֲנִ֖י שֹׁכֵ֣ן בְּתוֹכָ֑הּ כִּ֚י אֲנִ֣י יְהוָ֔ה שֹׁכֵ֕ן בְּת֖וֹךְ בְּנֵ֥י יִשְׂרָאֵֽל׃ (פ)
35:34
You shall not defile the land in which you live, in which I Myself abide, for I the LORD abide among the Israelite people.

And thou shalt not defile the land which ye inhabit, in the midst of which I dwell; for I the LORD dwell in the midst of the children of Israel.’

וְלָא תְסָאֲבוּן יָת אַרְעָא דִּי אַתּוּן יָתְבִין בַּהּ דִּי שְׁכִינְתִּי שָׁרְיָא בְּגַוָּהּ אֲרֵי אֲנָא יְיָ דִּשְׁכִנְתִּי שָׁרְיָא בְּגוֹ בְּנֵי יִשְׂרָאֵל:
אשר אני שכן בתוכה. שֶׁלֹּא תַשְׁכִּינוּ אוֹתִי בְטֻמְאָתָהּ:
כי אני ה' שכן בתוך בני ישראל. אַף בִּזְמַן שֶׁהֵם טְמֵאִים שְׁכִינָה בֵינֵיהֶם (ספרי):
