Deuteronomy 24:5–24:13
כ"ד:ה׳ כִּֽי־יִקַּ֥ח אִישׁ֙ אִשָּׁ֣ה חֲדָשָׁ֔ה לֹ֤א יֵצֵא֙ בַּצָּבָ֔א וְלֹא־יַעֲבֹ֥ר עָלָ֖יו לְכָל־דָּבָ֑ר נָקִ֞י יִהְיֶ֤ה לְבֵיתוֹ֙ שָׁנָ֣ה אֶחָ֔ת וְשִׂמַּ֖ח אֶת־אִשְׁתּ֥וֹ אֲשֶׁר־לָקָֽח׃ (ס)
24:5 When a man has taken a bride, he shall not go out with the army or be assigned to it for any purpose; he shall be exempt one year for the sake of his household, to give happiness to the woman he has married.
24:5 When a man taketh a new wife, he shall not go out in the host, neither shall he be charged with any business; he shall be free for his house one year, and shall cheer his wife whom he hath taken.
כ"ד:ה׳ אֲרֵי יִסַּב גְּבַר אִתְּתָא חַדְתָּא לָא יִפּוֹק בְּחֵילָא וְלָא יֵעִבַר עֲלוֹהִי לְכָל מִדָּעַם פָּנֵי יְהֵי לְבֵיתֵיהּ שַׁתָּא חֲדָא וְיַחְדֵּי יָת אִתְּתֵיהּ דִּי נְסַב:
כ"ד:ו׳ לֹא־יַחֲבֹ֥ל רֵחַ֖יִם וָרָ֑כֶב כִּי־נֶ֖פֶשׁ ה֥וּא חֹבֵֽל׃ (ס)
24:6 A handmill or an upper millstone shall not be taken in pawn, for that would be taking someone’s life in pawn.
24:6 No man shall take the mill or the upper millstone to pledge; for he taketh a man’s life to pledge.
כ"ד:ו׳ לָא יִסַּב מַשְׁכּוֹנָא רִחְיָא וְרִכְבָּא אֲרֵי בְהוֹן מִתְעֲבֵד מָזוֹן לְכָל נְפַשׁ:
כ"ד:ז׳ כִּי־יִמָּצֵ֣א אִ֗ישׁ גֹּנֵ֨ב נֶ֤פֶשׁ מֵאֶחָיו֙ מִבְּנֵ֣י יִשְׂרָאֵ֔ל וְהִתְעַמֶּר־בּ֖וֹ וּמְכָר֑וֹ וּמֵת֙ הַגַּנָּ֣ב הַה֔וּא וּבִֽעַרְתָּ֥ הָרָ֖ע מִקִּרְבֶּֽךָ׃
24:7 If a man is found to have kidnapped a fellow Israelite, enslaving him or selling him, that kidnapper shall die; thus you will sweep out evil from your midst.
24:7 If a man be found stealing any of his brethren of the children of Israel, and he deal with him as a slave, and sell him; then that thief shall die; so shalt thou put away the evil from the midst of thee.
כ"ד:ז׳ אֲרֵי יִשְׁתְּכַח גְּבַר גָּנֵב נַפְשָׁא מֵאֲחוֹהִי מִבְּנֵי יִשְׂרָאֵל וְיִתָּגַר בֵּיהּ וִיזַבְּנִנֵּיהּ וְיִתְקְטֵל גַּנָּבָא הַהוּא וּתְפַלֵּי עָבֵד דְּבִישׁ מִבֵּינָךְ:
כ"ד:ח׳ הִשָּׁ֧מֶר בְּנֶֽגַע־הַצָּרַ֛עַת לִשְׁמֹ֥ר מְאֹ֖ד וְלַעֲשׂ֑וֹת כְּכֹל֩ אֲשֶׁר־יוֹר֨וּ אֶתְכֶ֜ם הַכֹּהֲנִ֧ים הַלְוִיִּ֛ם כַּאֲשֶׁ֥ר צִוִּיתִ֖ם תִּשְׁמְר֥וּ לַעֲשֽׂוֹת׃ (ס)
24:8 In cases of a skin affectionbCf. Lev. 13.1 ff. be most careful to do exactly as the levitical priests instruct you. Take care to do as I have commanded them.
24:8 Take heed in the plague of leprosy, that thou observe diligently, and do according to all that the priests the Levites shall teach you, as I commanded them, so ye shall observe to do.
כ"ד:ח׳ אִסְתַּמַּר בְּמַכְתַּשׁ סְגִירוּ לְמִטַּר לַחֲדָא וּלְמֶעְבָּד כְּכֹל דִּי יַלְּפוּן יָתְכוֹן כָּהֲנַיָּא לֵוָאֵי כְּמָא דִי פַקֶּדְתִּנּוּן תִּטְּרוּן לְמֶעְבָּד:
כ"ד:ח׳ אור החיים
1הִשָּׁמֶר בְּנֶגַע וְגוֹ׳ זָכוֹר וְגוֹ׳. לְדִבְרֵיהֶם זִכְרוֹנָם לִבְרָכָה (שבת קלב:) שֶׁאָמְרוּ שֶׁבָּא לְהַזְהִיר לְבַל יָקוֹץ בַּהַרְתּוֹ, נִתְכַּוֵּן בְּהַסְמָכַת זָכוֹר אֵת אֲשֶׁר עָשָׂה ה׳ לְמִרְיָם לְהוֹדִיעַ שֹׁרֶשׁ שֶׁמִּמֶּנּוּ יִהְיֶה הַנֶּגַע וְאוֹתוֹ יְצַו ה׳ לָקֹץ וְרָפָא.
השמר בנגע הצרעת, "Take heed of the affliction known as Tzoraat, etc." According to Shabbat 132 on our verse the meaning is that a person afflicted with this plague must not remove the afflicted section of his skin in order to remove the evidence of his disease. The reason why the Torah added that we should remember what G'd had done to Miriam is intended to remind us of the true source of such an affliction and to remind those who think they can cure it by cutting off the skin where it appears that they are on the wrong track. The way to get rid of this affliction is to remove its cause, i.e. to rehabilitate a character fault which caused it in the first place.
כ"ד:ט׳ זָכ֕וֹר אֵ֧ת אֲשֶׁר־עָשָׂ֛ה יְהוָ֥ה אֱלֹהֶ֖יךָ לְמִרְיָ֑ם בַּדֶּ֖רֶךְ בְּצֵאתְכֶ֥ם מִמִּצְרָֽיִם׃ (ס)
24:9 Remember what the LORD your God did to Miriam on the journey after you left Egypt.cSee Num. 12.10 ff.
24:9 Remember what the LORD thy God did unto Miriam, by the way as ye came forth out of Egypt.
כ"ד:ט׳ הֲוֵי דְכִיר יָת דִּי עֲבַד יְיָ אֱלָהָךְ לְמִרְיָם בְּאָרְחָא בְּמִפָּקְכוֹן מִמִּצְרָיִם:
כ"ד:י׳ כִּֽי־תַשֶּׁ֥ה בְרֵֽעֲךָ מַשַּׁ֣את מְא֑וּמָה לֹא־תָבֹ֥א אֶל־בֵּית֖וֹ לַעֲבֹ֥ט עֲבֹטֽוֹ׃
24:10 When you make a loan of any sort to your countryman, you must not enter his house to seize his pledge.
24:10 When thou dost lend thy neighbour any manner of loan, thou shalt not go into his house to fetch his pledge.
כ"ד:י׳ אֲרֵי תַרְשֵׁי בְחַבְרָךְ רְשׁוּ מִדָּעַם לָא תֵעוּל לְבֵיתֵיהּ לְמִסַּב מַשְׁכּוֹנֵיהּ:
כ"ד:י"א בַּח֖וּץ תַּעֲמֹ֑ד וְהָאִ֗ישׁ אֲשֶׁ֤ר אַתָּה֙ נֹשֶׁ֣ה ב֔וֹ יוֹצִ֥יא אֵלֶ֛יךָ אֶֽת־הַעֲב֖וֹט הַחֽוּצָה׃
24:11 You must remain outside, while the man to whom you made the loan brings the pledge out to you.
24:11 Thou shalt stand without, and the man to whom thou dost lend shall bring forth the pledge without unto thee.
כ"ד:י"א בְּבָרָא תְּקוּם וְגַבְרָא דִּי אַתְּ רָשֵׁי בֵיהּ יַפֵּק לְוָתָךְ יָת מַשְׁכּוֹנָא לְבָרָא:
כ"ד:י"ב וְאִם־אִ֥ישׁ עָנִ֖י ה֑וּא לֹ֥א תִשְׁכַּ֖ב בַּעֲבֹטֽוֹ׃
24:12 If he is a needy man, you shall not go to sleep in his pledge;
24:12 And if he be a poor man, thou shalt not sleep with his pledge;
כ"ד:י"ב וְאִם גְּבַר מִסְכֵּן הוּא לָא תִשְׁכּוּב בְּמַשְׁכּוֹנֵיהּ:
כ"ד:י"ג הָשֵׁב֩ תָּשִׁ֨יב ל֤וֹ אֶֽת־הַעֲבוֹט֙ כְּבֹ֣א הַשֶּׁ֔מֶשׁ וְשָׁכַ֥ב בְּשַׂלְמָת֖וֹ וּבֵֽרֲכֶ֑ךָּ וּלְךָ֙ תִּהְיֶ֣ה צְדָקָ֔ה לִפְנֵ֖י יְהוָ֥ה אֱלֹהֶֽיךָ׃ (ס)
24:13 you must return the pledge to him at sundown, that he may sleep in his cloth and bless you; and it will be to your merit before the LORD your God.
24:13 thou shalt surely restore to him the pledge when the sun goeth down, that he may sleep in his garment, and bless thee; and it shall be righteousness unto thee before the LORD thy God.
כ"ד:י"ג אָתָבָא תָתֵב לֵיהּ יָת מַשְׁכּוֹנָא כְּמֵעַל שִׁמְשָׁא וְיִשְׁכּוּב בִּכְסוּתֵיהּ וִיבָרֵכִנָּךְ וְלָךְ תְּהֵי זְכוּתָא קֳדָם יְיָ אֱלָהָךְ:
כבוא השמש. אִם כְּסוּת לַיְלָה הוּא, וְאִם כְּסוּת יוֹם — הַחֲזִירֵהוּ בַבֹּקֶר, וּכְבָר כָּתוּב בִּוְאֵלֶּה הַמִּשְׁפָּטִים (כ"ב) "עַד בֹּא הַשֶּׁמֶשׁ תְּשִׁיבֶנּוּ לוֹ" — כָּל הַיּוֹם תְּשִׁיבֶנּוּ לוֹ, וּכְבֹא הַשֶּׁמֶשׁ תִּקָּחֶנּוּ:
